1. Overview

These Terms of Service ("Terms") govern your access to and use of ninetynineactivewear.com and any purchase you make through it (together, the "Site"). The words "we", "us" and "our" refer to Ninety Nine. The words "you" and "your" refer to you, the visitor or customer.

By browsing the Site, subscribing to our list, or placing an order, you confirm that you have read, understood and agreed to these Terms. If you do not agree to any part of them, please do not use the Site.

Our Refund Policy, Shipping Policy and Privacy Policy are incorporated into these Terms by reference and form part of your agreement with us. Where a specific policy conflicts with these Terms, the specific policy applies.

2. Who we are

Ninety Nine is an activewear brand based in Lebanon, selling directly to customers online.

We do not operate a physical store, showroom, or pick-up point. All orders and exchanges are handled by our delivery partner.

3. Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order. By ordering, you confirm that you meet this requirement, that the contact and delivery details you give are your own or that you are authorized to use them, and that you will be able to pay the courier in cash on delivery.

4. Your account

You can shop as a guest or create an account. If you create one, you are responsible for keeping your login details confidential and for all activity that takes place under your account. Please tell us straight away if you believe someone else has accessed it.

You agree to give accurate, current and complete information when you register or check out, and to keep it updated. We may suspend or close an account that we reasonably believe has been used fraudulently or in breach of these Terms.

5. Products, sizing and color

Every product page carries its own size chart, measured from the garment itself in centimeters. Measurements are taken flat and may vary by roughly 1–2 cm between pieces, which is normal for cut-and-sew activewear.

We photograph our products as accurately as we can, but screens render color differently. We cannot guarantee that the color you see on your device exactly matches the color of the item you receive. A slight difference in shade is not considered a fault.

Products are sold for personal use. We do not permit purchase for commercial resale without our written agreement.

6. Prices and currency

All prices are shown in US dollars (USD) and are inclusive of any applicable taxes unless stated otherwise at checkout. Delivery charges are added at checkout and shown before you pay.

We may change prices at any time without notice. The price that applies to your order is the price displayed at the moment you complete checkout. A price change after your order is confirmed does not entitle you to a refund of the difference, and does not allow us to charge you more.

7. Orders and acceptance

Placing an order is an offer to buy, not a binding contract. The order confirmation email we send is an acknowledgement that we received your order — it is not acceptance of it. A contract is formed only when we dispatch the items to you.

We may decline or cancel any order, in whole or in part, including where:

  • the item is out of stock or an inventory error has occurred;
  • a price or product description was listed incorrectly;
  • we suspect a false or malicious order, or resale activity;
  • we are unable to reach you on the phone number given to confirm the order ;
  • a previous order to the same customer was refused at the door or left unpaid.

Because payment is taken in cash on delivery, cancelling an order before it is delivered costs you nothing and no refund is required.

Cancelling your own order:

You can cancel an order free of charge at any point before it leaves our warehouse — message us on WhatsApp at +961 70 610 016 with your order number. Once the courier has collected it, please refuse the delivery at the door instead. We may decline future orders from a customer who repeatedly refuses deliveries.

8. Stock and availability

We hold limited quantities and stock levels shown on the Site are updated as accurately as we can manage. On rare occasions an item may sell out between the moment you add it to your cart and the moment you pay. If that happens we will contact you and either arrange an alternative or remove that item from your order before it ships. As nothing is charged upfront, you are never out of pocket.

9. Payment — cash on delivery

Cash on delivery is currently the only payment method we accept. We do not take card payments, bank transfers or online payments of any kind, and we will never ask you for card details.

Nothing is charged when you place your order. You pay our courier in cash at the moment your order is handed to you, and the amount due is the total shown at checkout: the price of your items plus the delivery fee.

Payment is due in full on delivery. We cannot release an order that is partially paid, and the courier is not authorized to accept part payment or to hold items for later payment.

If you are not at the delivery address, someone else at that address may accept and pay for the order on your behalf. If nobody is available, our courier will attempt to reach you on the number you provided and arrange a second attempt.

If a delivery is refused at the door, or payment cannot be made when the courier arrives, the order is returned to us and cancelled. You owe nothing for a refused order, but we may decline to accept future orders from a customer who repeatedly refuses deliveries or is unreachable, and we may ask for confirmation by WhatsApp before dispatching a future order.

If we add other payment methods in future, they will be shown at checkout and this section will be updated.

10. Shipping and delivery

We deliver within Lebanon only. Delivery times, charges and courier arrangements are set out in our Shipping Policy, which forms part of these Terms.

Risk in the goods passes to you on delivery. Please make sure the delivery address you enter is complete and correct — we are not responsible for delay or failed delivery caused by an incorrect or incomplete address.

11. Exchanges and refunds

We offer exchanges only, within 14 days of delivery, on unworn and unwashed items. We do not offer refunds for change of mind. Exchanges are collected and delivered by our courier and normal delivery charges apply, paid in cash to the courier at that visit. Where the replacement item costs more than the original, the difference is also paid in cash at that visit; where it costs less, we will agree the difference with you before the exchange goes ahead. Nothing in these Terms or in our Refund Policy limits any right you have under applicable consumer protection law.

12. Promotions, discount codes and gift cards

Discount codes and promotions are offered at our discretion and may be withdrawn or changed at any time. Unless we say otherwise, codes cannot be combined, have no cash value, apply only to full-price items, and cannot be applied retroactively to an order already placed.

Where we run a giveaway or competition, any additional rules published with it apply alongside these Terms.

13. Product care and intended use

Our products are activewear designed for training and everyday wear. Please follow the care instructions on the garment label — machine washing at high temperatures, tumble drying, bleaching or ironing printed or compressive fabrics will damage them, and damage caused that way is not a manufacturing fault.

Exercise carries inherent risk. Our products are garments, not protective or medical equipment, and we are not responsible for injury arising from physical activity.

14. Marketing communications

If you subscribe to our list or opt in at checkout, we may send you emails about new arrivals, restocks and offers. You can unsubscribe at any time using the link in any marketing email. We will still send transactional messages relating to your orders.

15. Acceptable use

You agree not to use the Site:

  • for any unlawful purpose, or to solicit others to act unlawfully;
  • to infringe our intellectual property rights or those of anyone else;
  • to harass, abuse, insult, defame or discriminate against any person or group;
  • to submit false or misleading information;
  • to upload or transmit viruses or any other malicious code;
  • to scrape, harvest or collect personal information about other users;
  • to spam, phish, or interfere with the security features of the Site;
  • to place orders through automated means, bots, or on behalf of resellers.

We may terminate your use of the Site for breaching any of the above.

16. Errors, inaccuracies and omissions

Occasionally the Site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, delivery charges or availability. We reserve the right to correct any error and to change or update information, or cancel an affected order, at any time without prior notice.

We are under no obligation to update information on the Site except as required by law. A displayed update or refresh date does not mean that every piece of information has been reviewed on that date.

17. Disclaimer

We work hard to keep the Site available and accurate, but we do not guarantee that it will be uninterrupted, timely, secure or error-free, or that results obtained from using it will be accurate or reliable. Except as expressly stated in these Terms or required by law, the Site and our products are provided "as is" and "as available".

18. Indemnity

You agree to indemnify and hold harmless Ninety Nine from any claim or demand, including reasonable legal fees, made by a third party arising out of your breach of these Terms or your violation of any law or the rights of a third party.

19. Privacy

Your personal information is handled in line with our Privacy Policy, which explains what we collect, why, and what rights you have over it.

20. Events outside our control

We are not liable for any failure or delay in performing our obligations where that failure results from events beyond our reasonable control, including strikes, courier failure, power or internet outages, extreme weather, civil unrest, or government restrictions.

21. Changes to these Terms

We may update these Terms from time to time. The current version is always the one posted on this page, and changes take effect as soon as they are published. It is your responsibility to check this page periodically. Continuing to use the Site after a change means you accept the updated Terms.
